Mr. Rejman:     Good evening, this is the Zoning Board of Appeals.  Tonight we have:

55 Washington Street
151 Seymour Street

Any corrections to the minutes of the previous meeting?  Hearing none, the minutes are accepted as typed.

        

ZONING BOARD OF APPEALS

55 Washington Street.  R2 zoning district.   Teresa Taylor, applicant.  Area variance for 15 square foot sign where only 10 square feet is allowed.

Mr. Rejman:     55 Washington Street, are you here?  Please approach the podium, use the mike and tell us your name.

Mr. Taylor:     My name is Teresa Taylor.

Mr. Rejman:     Tell us what you would like to do there.

Ms. Taylor:     I want to put a 24 square foot neon sign that will hang over the building at a location that had trouble knowing when it was open.  Just the name, Taylor’s Tavern and it will sit up above doesn’t hang over the building.  

Mr. Rejman:     I looked at it, the blue sign stick out, but your sign isn’t going to stick out further than that?

Ms. Taylor:     Not at all.  On the corner of West and Washington, there is an upstairs apartment so there is like an “L” shape the sign will go above that, will not protrude over the building at all.

Mr. Rejman:     Ok, if I am coming off the arterial down to you, going north on Wall, I will be able to read your sign?

Ms. Taylor:     You will be able to read my sign from the arterial.

Mr. Rejman:     OK, it is going to be pointed towards the prison wall.  

Ms. Taylor:     Right.

Mr. Darrow:     Basically if you are walking up or down the sidewalk, you look up you see the sign?

Ms. Taylor:     Yes.

Mr. Rejman:     Just like Balloon’s pretty much.

Ms. Taylor:     Looks similar but it is up higher.

Mr. Rejman:     Just wasn’t sure if it was on that street or the other street.

        OK, questions from the board?

Ms. Marteney:   Certainly understandable.

Mr. Darrow:     Not really.

Mr. Rejman:     Any one here wishing to speak for or against the application?  Hearing none, we will close the public portion.  Have a seat.

Mr. Darrow:     Personally I view the area variance of 5 feet minimal, not obtrusive, when you consider the location of it that was the old Italian Village that was in a residential neighborhood and the ability to see it from the arterial I think is positive, did not over size it to see it.  

Mr. Rejman:     The design on this will kind of match Balloon’s, same period type.  

Mr. Darrow:     Looks nice.

        I would like to make motion that we grant Teresa Taylor for Taylor’s Tavern at 55 Washington Street, Auburn, a 5-foot area variance for the purpose of erecting a sign at 55 Washington Street as per submitted plans.

Mr. Westlake:   I second that motion.

151 Seymour Street.  R2 zoning district.  Michael Kozanitis, applicant.  Area variance for 2nd accessory structure.  Total square footage to accessory structures exceeds amount allowed.

Mr. Rejman:     151 Seymour Street please.  State your name for the record.

Mr. Kozanitis:  Mike Kozanitis.  

Mr. Rejman:     Tell us what the issue is there.

Mr. Kozanitis:  Back in 1985 there was an old building, I cleaned it up and I came to the City and they told me when you can build it, build it.  I built it now, probably will move it in the future, but now I need a variance.  

Mr. Rejman:     That building, it is a nice building.

Mr. Kozanitis:  Nice for storage.

Mr. Rejman:     Have some pictures, we will wait while they go around.  (Brian Hicks shows pictures to the board members).

        There are a lot of comments, this is a cute building.  Where did you find this building?

Mr. Kozanitis:  I made it.

Mr. Rejman:     Oh, made it your self?  

Mr. Kozanitis:  Yes.

Ms. Marteney:   Cute!  Nice job!

Mr. Rejman:     Questions from the board?  

Ms. Marteney:   He is far enough back, you don’t see it.  Big deep lot behind Kinney Drugs.  

Mr. Rejman:     Over 200 feet back from the street.  

        Any one wishing to speak for or against the application?  Hearing none, close the public portion, have a seat.

        Size of the lot.

Ms. Marteney:   Doesn’t affect the neighbors in the backside either they all have large lots.

Mr. Darrow:     One question, are we going to need two variances?  One for square footage because it exceeds 750, that second one because you are only allowed one detached accessory structure so another variance will be needed for a second detached accessory structure.  Am I correct on that?

Mr. Hicks:      The way we determine it is any structure on the property whether it is affixed or not is accessory to the primary use.

Mr. Kozanitis:  That is canvass; looks like the wind will destroy it.

Mr. Darrow:     We need a variance for that too right Brian?

Mr. Hicks:      Two accessory structures, there are two new ones and he does have a garage.

Mr. Darrow:     Detached or attached?

Mr. Hicks:      Detached.

Mr. Darrow:     So there are two accessory structures besides the square footage.

Mr. Hicks:      Right.

Mr. Darrow:     Ok, that makes more sense.  

        I would like to make a motion that we grant Michael Kozanitis of 151 Seymour Street, a 452 square foot area variance to exceed the accessory structure cap of 750 square feet and for two extra accessory structures to be set as submitted in plot plan at 151 Seymour Street.

Mr. Baroody:    I second that.

Ms. Brower:     So the canvass one is part of the picture.  How long is that going to be there and what regulations pertain to it?

Mr. Hicks:      We don’t have a time limit regulation on that a permit is required for that structure and this structure the solid wood one will also need a permit, we can’t grant permits for either one until a variance is granted.

Ms. Brower:     If we grant the variance

Mr. Hicks:      It can stay forever.

Mr. Rejman:     Wait, once it falls down, just like a porch, once a porch comes off a house and you are going to rebuild it, you need another variance.  So when that canvass thing comes down, that goes away and if another one is wanted to be put in its place, they will have to come before us.

Ms. Brower:     OK.
